3. General Principles
3.1 What data do we collect from you, and from whom do we receive this data?
Primarily, we process personal data that you provide to us or that we collect when operating our website. In certain cases, we also receive personal data about you from third parties. These may include the following categories:
- Personal details (name, address, birth data, etc.);
- Contact information (mobile number, email address, etc.);
- Financial data (e.g., account information);
- Online identifiers (e.g., cookie IDs, IP addresses);
- Location and traffic data;
- Audio and visual recordings;
- Particularly sensitive data (e.g., biometric data or health information).
3.2 Under what conditions do we process your data?
We treat your data confidentially and according to the purposes defined in this privacy policy. We ensure transparent and proportional processing.
Should we exceptionally be unable to adhere to these principles, data processing may still be lawful if there is a justification. A justification may include:
- Your consent;
- The execution of a contract or pre-contractual measures;
- Our legitimate interests, provided your interests do not override them.
3.3 How can you withdraw your consent?
If you have given us consent to process your personal data for specific purposes, we process your data within the scope of this consent, unless we have another legal basis.
You can withdraw your consent at any time by sending an email to the address provided in the imprint. Processing already carried out is not affected.
3.4 Under what circumstances can we share your data with third parties?
a. Principle
We may need to engage third parties or affiliated companies for processing your data (so-called data processors). Categories of recipients include:
- Accounting, fiduciary, and auditing firms;
- Consulting firms (legal advice, taxes, etc.);
- IT service providers (web hosting, support, cloud services, web design, etc.);
- Payment service providers;
- Providers of tracking, conversion, and advertising services.
We ensure that these third parties and our affiliates meet data protection requirements and treat your personal data confidentially.
In certain circumstances, we may also be required to disclose your personal data to authorities.
b. Visiting our Social Media Channels
We may have embedded links to our social media channels on our website. This is usually apparent (typically via corresponding symbols). Clicking these symbols will redirect you to our social media channels.
In this case, social media providers may learn that you accessed their platform via our website. These providers may use the collected data for their purposes. We note that we have no knowledge of the data transmitted or its usage by the providers.
c. Transfer Abroad
As part of order processing, your personal data may be transferred to companies abroad. These companies are subject to the same data protection obligations as we are. The transfer may occur worldwide.
If the level of data protection does not correspond to that of Switzerland, we conduct a prior risk assessment and contractually ensure equivalent protection (e.g., via the new standard contractual clauses of the EU Commission or other legally prescribed measures). Should our risk assessment be negative, we take additional technical measures to protect your data. You can access the EU Commission's standard contractual clauses via the following link: https://commission.europa.eu/publications/standard-contractual-clauses-controllers-and-processors-eueea_de
3.5 How long do we store your data?
We store personal data only as long as necessary to fulfill the individual purposes for which it was collected.
Data collected during your visit to our website is retained for twelve months. An exception applies to analytics and tracking data, which may be kept longer.
We retain contract data longer due to legal requirements. In particular, we are obligated to keep business communications, closed contracts, and booking records for up to 10 years. Once we no longer need such data for service delivery, it will be blocked and used solely for billing and tax purposes.
3.6 How do we protect your data?
We will securely store your data and take all reasonable measures to protect it from loss, access, misuse, or alteration.
Our contractors and employees with access to your data are obligated to comply with data protection regulations. In some cases, it will be necessary to forward your inquiries to our affiliated companies. Your data will also be treated confidentially in these cases.
Within our website, we use the SSL (Secure Socket Layer) protocol combined with the highest encryption level supported by your browser.
3.7 What rights do you have?
a. Right to Information
You can request information about the data we store about you at any time. Please send your request for information along with proof of identity to info@rubioconsulting.ch.
You also have the right to receive your data in a common file format if we process your data automatically, and if:
- You have consented to the processing of this data; or
- You have provided data in connection with the conclusion or execution of a contract.
We may restrict or deny access to your data if it conflicts with our legal obligations, legitimate public or private interests, or the interests of a third party.
Your request will be processed within the statutory processing period of 30 days. However, this period may be extended due to high request volumes, legal or technical reasons, or if we need more details from you. You will be informed of the extension of the period in a timely manner, at least in text form.
b. Deletion and Correction
You can request the deletion or correction of your data at any time. We may refuse the request if legal regulations require us to retain the data for a longer period or unchanged, or if a permissible reason opposes your request.
Please note that exercising your rights may conflict with contractual agreements and have corresponding effects on contract execution (e.g., early termination or cost consequences).
c. Legal Remedies
If you are affected by the processing of personal data, you have the right to enforce your rights in court or file a complaint with the relevant supervisory authority. The competent supervisory authority in Switzerland is the Federal Data Protection and Information Commissioner: https://www.edoeb.admin.ch
3.8 Changes to the Privacy Policy
We may change this privacy policy at any time. The changes will be published on https://www.rubioconsulting.ch/, and you will not be separately notified.
4. Individual Data Processing Operations
4.1 Providing the Website and Creating Log Files
What information do we receive and how do we use it?
When you visit https://www.rubioconsulting.ch/, certain data is automatically stored on our servers or the servers of services and products we use and/or have installed for system administration, statistical, backup, or tracking purposes. This data includes:
- The name of your Internet service provider;
- Your IP address (if applicable);
- The version of your browser software;
- The operating system of the computer accessing the URL;
- The date and time of access;
- The website from which you accessed the URL;
- The search terms you used to find the URL.
Why are we allowed to process this data?
This data cannot be assigned to a specific person, and it is not merged with other data sources. Log file storage ensures the website's functionality and the security of our IT systems. This constitutes our legitimate interest.
How can you prevent data collection?
The data is stored only as long as necessary to achieve the purpose for which it was collected. Accordingly, the data is deleted at the end of each session. Log file storage is essential for website operation, so you have no option to object to it.
4.2 Google Tag Manager
We use Google Tag Manager, a service provided by Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; "Google"), to manage website tags through an interface. The Google Tag Manager itself (which implements the tags) is a cookie-less domain and does not process personal data. The service triggers other tags, which may collect data. Google Tag Manager does not access this data. If deactivation is carried out at the domain or cookie level, it remains effective for all tracking tags implemented with Google Tag Manager.
By using Google Tag Manager, scripts (tags) are automatically activated on our website, and data from your browser may be transmitted to Google. This data may include information about your IP address, the browser you use, the subpages of our website you visited, and other interactions during your website visit.
4.3 Bunny CDN
Our website uses Bunny CDN (Content Delivery Network), a service of Bunny Way d.o.o., Cesta v Gorice 34b, 1000 Ljubljana, Slovenia. A Content Delivery Network (CDN) is a network of distributed servers designed to deliver website content, particularly large media files such as photos or graphics, faster to users.
By using Bunny CDN, data such as your IP address and information about the browser and device you use may be transmitted to Bunny CDN. This is done to determine the fastest server for delivering the content to your location and to optimize transfer speed and performance.
For more information on data protection in connection with Bunny CDN, please see the Bunny CDN privacy policy: https://bunny.net/privacy. If you have questions about the data collected by Bunny CDN or wish to exercise your rights regarding this data, you should contact Bunny Way d.o.o. directly.
4.4 Bunny Fonts
Our website uses Bunny Fonts, a font service provided by Bunny Way d.o.o., Cesta v Gorice 34b, 1000 Ljubljana, Slovenia. Bunny Fonts allow us to use specific fonts on our website to improve design and user experience.
When you visit our website, the required fonts are loaded into your browser cache to correctly display text and fonts. In doing so, data such as your IP address and information about the browser you use may be transmitted to Bunny Fonts to deliver the fonts correctly.
4.5 Cloudflare CDN
Our website uses the Content Delivery Network (CDN) service from Cloudflare, Inc., 101 Townsend St, San Francisco, CA 94107, USA ("Cloudflare"). A CDN helps deliver website content faster by distributing copies of the content to a network of fast-loading servers.
When you visit our website, your IP address is transmitted to Cloudflare, and cookies may be set in your browser, which are necessary to optimize and secure the service. Cloudflare uses this data to speed up data traffic between our web server and your device and to protect our website from attacks.
4.6 Font Awesome
Font Awesome is operated by Fonticons, Inc., located at 6 Porter Road, Apartment 3R, Cambridge, MA 02140, USA. Font Awesome is a collection of scalable vector icons that allows web developers to integrate various icons and social logos into their websites.
We use Font Awesome to integrate visual icons on our website. This may include icons for user interfaces, social media links, or other graphic elements that enhance the design and user experience of our website.
Font Awesome may load web fonts from Fonticons, Inc.'s servers when a user visits our website. During this process, the user's IP address is sent to Fonticons, Inc. This is necessary for the user's web browser to display Font Awesome icons correctly.
Fonticons, Inc. stores user IP addresses only briefly and solely for the purpose of providing the Font Awesome icons. There is no further storage or analysis.
4.7 Google Fonts API
We use the Google Fonts API, a service of Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; "Google"), to integrate fonts into our website. By integrating these fonts, your browser connects to Google's servers to download and display the fonts correctly.
Through this connection, data, particularly your IP address and information about the browser you use, may be transmitted to Google and stored on Google's servers. These servers may be located in the USA or other countries.
If you want to prevent data transmission in connection with the Google Fonts API, you can block access to the domain fonts.googleapis.com in your browser settings. Please note that this may result in our website not displaying correctly.
4.8 jQuery CDN
Our website uses the "jQuery CDN" (Content Delivery Network), provided by the jQuery Foundation. The jQuery Foundation is a non-profit organization dedicated to developing and supporting open-source software, particularly the jQuery library.
jQuery is a widely-used JavaScript library that allows us to make website functions more efficient and user-friendly. By using the jQuery CDN, we can ensure that this library loads quickly and reliably on our website, improving load times and overall user experience.
The jQuery CDN uses cookies and similar technologies to process user requests and optimize library delivery. In the process, user IP addresses and browser information may be collected to ensure the best performance and compatibility.
If you do not want your data to be collected by the jQuery CDN, you can configure your browser settings to block content from external sources. However, please note that this may affect the functionality and user experience of our website.
4.9 jsDelivr
We use the jsDelivr service, an open-source CDN (Content Delivery Network), to load certain libraries and scripts faster and more reliably. This service is provided by ProspectOne Sp. z o.o., ul. Krolweska 65A, 30-081 Krakow, Poland.
By integrating jsDelivr, data such as your IP address, information about the browser used, the operating system, and the duration of the page visit are transmitted to jsDelivr's servers when you access our website. This is done to deliver the content faster and more efficiently to your browser and reduce the website's loading time.
jsDelivr uses this data to ensure content delivery and create statistical analyses of the use of their service. The data is not combined with other data sources or used for advertising purposes.
Using jsDelivr serves to optimize and improve the performance of our website. Data processing is based on our legitimate interest in efficient and secure website delivery.
4.10 Google reCaptcha
We use the reCAPTCHA service of Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; "Google") to protect against unwanted requests via the contact form on our website. The query distinguishes whether the input is made by a human or abusively through automated, machine processing. During the query, information such as your IP address or behavior while filling out the form may be transmitted to Google.
For this purpose, your input is transmitted to Google and further processed there. By using reCAPTCHA, you agree that your recognition input may contribute to the digitization of old works. If IP anonymization is activated on this website, your IP address will be truncated by Google within member states of the European Union or in other states that are party to the Agreement on the European Economic Area.
Only in exceptional cases is the full IP address transmitted to a Google server in the USA and truncated there. On behalf of the operator of this website, Google will use this information to evaluate your use of this service. The IP address transmitted by your browser as part of reCAPTCHA will not be merged with other Google data.
5. BrainBox Generators
BrainBox Generators is a service of BrainBox Solutions GmbH, designed to identify all data protection-relevant services on a website and help create the privacy policy. No personal data is collected or processed in the process.
